This evening the Delft police attempted to illegally evicting a family from their home in new N2 Gateway BNG government houses

The original owner received the house 2 years ago and, because she already had a place to stay, immediately handed it over to a family of 6 who have been the tenants of the house until now. The act by the owner proves that, since she had an alternative place to stay, the owner had no right to receive the free government house in the first place.

However now, over 2 years later, the owner has returned and is demanding the eviction of the tenants who have nowhere else to go except the human dumping ground of Blikkiesdorp. Read the rest of this entry »

Abahlali are singing and protesting against the bulldozer and the police with courage and commitment. The bulldozer had to reverse. It is about to leave. The Durban comrades have have just phoned Delani Madondo from Umngeni Municipality, who says he is in church and will be working on Tuesday. He says that he does not know anything about the eviction that was happening now.

No Justice for Gympie Street!

On the 17th of June, the Cape High Court ruled in favour of Pastor Dennis Robertson, which means many people in Gympie Street are officially homeless. On the weekend only two families in Gympie Street were provided with alternative accommodation arranged by Councillor Shehaam Sims, most were not. Update on Skhoma Butchery eviction (12h53 – 4 June):

The eviction order was invalid and therefore illegal.  Skhoma Butchery was able to convince City officials and the Sheriff of the Court to return all material and put it back inside the Butchery.

  • What? SS Skhoma Butchery in Gugulethu being evicted
  • When? Right now! (09h40 – 4 June)

The owners and staff of Gugulethu’s famous Skhoma Butchery woke today to find out that they were being evicted.  They had no idea that this was going to happen as they had set an agreed date with Guguletu Square mall developers on when to move to their new premises.  The butchery is currently consulting their lawyer as to what to do.  It seems that there is an eviction letter from the 14th of May saying that occupants should be evicted.  However, this does not seem like a court order and this letter was never served on the occupants.

This kind of illegal or semi-legal actions by developers and government happens everyday in South Africa.  Fortunately for Skhoma owners, they can afford a lawyer.  But for poor South Africans, they rarely are able to stop themselves from being evicted illegally.

  • What? Gympie Street interdict to be heard at Cape High Court
  • When? 15h30 (on the 4 June)

Gympie Street residents will be in court at 15h30 where the judge will be hearing their interdict against the illegal eviction of two families.  Yesterday, the belongings of the Heyn and Petersen families were confiscated by Law Enforcement officials who claimed they would return their belongings once the families found a place to stay.  We are afraid we might not see our belongings again.

Opinion: Plato, DA must stick to law or be prosecuted

MAYOR Dan Plato claims that his Cape Town city administration lawfully demolished shacks in Macassar Village because they were “still being erected and not occupied”.

The people whose shacks were destroyed vigorously contest Plato’s claim that their shacks were not fully erected and that they were not yet unoccupied.

They are seeking legal assistance to be able to contest this in court.

There are independent eyewitnesses who can confirm that people had in fact moved into the shacks with their furniture before the first demolitions. Read the rest of this entry »

Gympie residents in Cape High Court this evening to have an urgent application heard

This evening, Gympie Street residents filed an urgent application at the Cape High Court.

The case was brought before Judge Maqubela in Court #7 and has now been postponed until Thursday 4th of June at 15h30.

As we have said before, the entire operation was done illegally and without consideration of the PIE Act. This is criminal.

Judge Maqubela proclaimed that he wants to be fair in this trail and was concerned about the lack of official papers authorising the sheriff of the court to enact the eviction.

On behalf of the residents, advocate Omar requested to know on what legal basis does the registrar of the court have the authority to evict people from their houses.

Poor residents illegally evicted in Woodstock because of City bylaw

Gympie Street residents illegally evicted and now on the street in front of their homes

About 10 residents of Gympie Street were illegally evicted earlier today by the sheriff of the court even though residents won their most recent court case against slumlord Pastor Dennis Roberston.

This was a surprise eviction with no advanced notice. The sheriff of the court was unable to provide a valid eviction order and residents were only given an ‘attachment order’ of and outdated eviction notice. When residents asked why they were being evicted, the sheriff told them that it was because they allegedly failed to appear in court on the 29th of April (which is untrue, see this press release).

About 7 people are currently camped out on Main Road, Woodstock, on the corner of Gympie Street. While their children have been taken in by their neighbours, they have nowhere else to go and so will stay on the pavement protecting their funiture until their lawyer overturns the illegal eviction. Private security thugs are currently in the homes and have bricked up the door to prevent entry.

Tomorrow, Advocate Zehir Omar will bring an urgent high court application as the landlord is acting stealthily and unlawfully in evicting the Heyn and Petersen families.
